Book of Evidence served in
Clonmany crash
case

A 23 year old man was
today served with the Book of Evidence on charges of
dangerous driving causing the deaths of eight men in
Inishowen.
Shaun Kelly, Hill Road, Ballymagan, Buncrana, was
served with the Book of Evidence by Garda Sgt Carol
Doherty at the local district court shortly before
10.30am.
It was expected the defendant would be sent forward
for trial to the May sitting of Letterkenny Circuit
Criminal Court. However the case was adjourned until
next month after the defence requested more
documentation.
Defence solicitor Ciaran MacLochlainn requested an
original copy of the accident scene photograph, an
original copy of an aerial photograph as well as
video of the scene. He also requested maps from the
accident scene.
Mr MacLochlainn said there were photocopies included
in the book of evidence but they were of ‘poor
quality’and the originals would be ‘vital’ to the
defence case. "We’re not trying to delay the matter.
We just want to have enough of the evidence in
advance to brief counsel," said Mr MacLochlainn.
Garda Inspector David Murphy asked for the case to
be adjourned for a month to allow the prosecution
provide the documentation requested. |

Mr Kelly, the sole
survivor of the crash, is charged with dangerous
driving causing the deaths of Hugh Friel (66), Urris,
Clonmany; Mark McLaughlin (21) of Ballinahone, Fahan;
Paul Doherty (19), of Ardagh, Ballyliffin; Ciaran
Sweeney (19), of Ballyliffin; PJ McLaughlin (21), of
Rockstown, Burnfoot; James McEleney (23), of
Meenaduff, Clonmany; Eamon McDaid (22), of
Ballymagan, Buncrana; and Damien McLaughlin (21), of
Umricam, Buncrana.
The accident happened at Glasmullen between Buncrana
and Clonmany on July 11, 2010. Judge Paul Kelly
remanded the defendant on continuing bail until
March 8. |
